No clandestine removal deemed if revenue failed to prove that assessee had cleared goods without pay

Excise & Customs : Demand cannot be confirmed alleging clandestine removal merely because goods bearing brand/trade name of assessee are found in certain godowns; department must show that goods were manufactured by assessee and cleared without payment of duty
