Custodian not liable to pay duty on goods if revenue failed to prove that pilferage had taken place

Excise & Customs : Custodian can be made liable to duty under Section 45(3) of Customs Act only if it is established that : (a) entire quantity of imported goods was unloaded and handed over to custodian; and (b) pilferage took place while goods were in custody of custodian
