Purchase tax isn't refundable unless doctrine of unjust enrichment is proved

CST/VAT : Refund of purchase tax cannot be granted if it results in unjust enrichment i.e., if tax paid forms part of final price and is passed on to purchaser, then assessee is not entitled to unjustly enrich himself by getting refund of such tax
