Non-delivery of notice by security agency to assessee wasn't a valid reason to condone delay in fili

Central Excise : Receipt of order by registered post with acknowledgement due amounts to 'communication of order'; ground that security agency hired by assessee did not hand over said post to assessee is not a valid ground to rebut presumption of said communication and accordingly, delay caused thereby cannot be condoned
