No dismissal of appeal by CESTAT on non-compliance with pre-deposit order if such order was further

Excise & Customs : CESTAT should not dismiss appeal for non-compliance of pre-deposit order where it is informed that pre-deposit order had been challenged before High Court; CESTAT must await result of hearing of appeal before High Court so as to ensure justice and avoid multiplicity of proceedings
